When you decide to sell your home without hiring a real estate agent, you will need the help of a lawyer or conveyancer to prepare all of the necessary documents to secure the sale.

Our Registered Conveyancer here at Mildwaters Lawyers can help you by preparing a private contract and form 1.

Contracts for all types of land

Whether your land is residential, commercial, industrial or farming land, we can tailor the contract to your particular needs so that it gives you the best possible protection in all of the circumstances.

Special conditions

We can discuss and prepare any special terms that you might require in your contract, such as terms allowing you to retain certain fixtures on the land or to remain living in the house on the land for a period of time after settlement rent free or to reap a crop on farming land after settlement and retain the sale proceeds of that crop.

Other necessary documents including the Form 1

In the process of preparing your contract, we will also make sure all the necessary documentation is provided for you and your buyer so that all of the legal requirements to make a sale binding are met.

Part of this process will involve us obtaining various searches and preparing the Form 1, which is an important document that is required under legislation and which must be prepared with care and attention to detail.  The Form 1 includes information about the property you are selling such as details about any encumbrances registered on the title.  It also includes information for the buyer about their rights such as their right to cool off after signing, which lasts for a limited time only.

Ensure you legally comply

There are many legal rules to adhere to when you are transferring property, so contact us today so we can ensure that all of your documentation complies with the law.
